Privacy Policy: ASUS ProArt Create League

At ASUS (“the Promoter”), we respect your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, and safeguard your data in accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA).

1. Information We Collect

To facilitate your entry into the ProArt Create League, we collect the following personal information:

  • Identity Data: Full Name and Surname.

  • Contact Data: Email address and cell phone number.

  • Submission Data: Your video entry, disclosures regarding AI usage, and any metadata associated with your file.

  • Technical Data: Information collected via cookies if you enter through our website.

2. Purpose of Processing

We use your information for the following specific reasons:

  • Competition Administration: To verify eligibility, process your entry, and contact you if you are a finalist or winner.

  • Mentorship & Final Rounds: To provide access to mentorship videos and communication for the final round.

  • Marketing: If you have opted in (as per Section 14 of the T&Cs), to send you news and promotional materials regarding ASUS ProArt products. You may opt out of these communications at any time.

  • Publicity: In line with Section 8 of the T&Cs, your name and submitted video may be used globally for marketing purposes.

3. Disclosure of Your Information

We do not sell your personal data. We may share your information only with:

  • Internal Teams: Employees involved in judging and logistics.

  • Service Providers: Third-party contractors (e.g., courier services for prize delivery or email marketing platforms).

  • Legal Authorities: When required to do so by South African law or the Consumer Protection Act.

4. International Data Transfers

As ASUS is a global brand, the video content you submit (which may include your likeness) may be stored or displayed on servers outside of South Africa. By entering, you consent to this cross-border transfer for the purposes of the "worldwide licence" granted in the T&Cs.

5. Data Security

We have implemented appropriate technical and organizational security measures to prevent your personal information from being accidentally lost, used, accessed in an unauthorized way, altered, or disclosed.

6. Your Legal Rights

Under POPIA, you have the right to:

  • Request Access to the personal information we hold about you.

  • Request Correction of any inaccurate or incomplete data.

  • Request Deletion of your data (subject to our legal obligations to retain records of the competition).

  • Object to Processing for direct marketing purposes.

7. Data Retention

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
