By accessing, browsing, or using this Website, or by participating in any competitions, bounties, or challenges hosted herein (collectively, the "Campaigns"), you ("User", "Participant", or "you") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), as well as our Privacy Policy and any specific campaign briefs provided. If you do not agree to these Terms, please do not use this Website.

1. ELIGIBILITY

1.1. The Campaigns hosted on this Website are open only to legal residents and citizens of the Republic of South Africa. 1.2. Participants must be 18 years of age or older at the time of entry. If a participant is under 18, they must obtain explicit written consent from a parent or legal guardian before submitting any entries or personal information. 1.3. Directors, members, partners, employees, agents, or consultants of ASUS, their marketing agencies, or any person who directly or indirectly controls or is controlled by ASUS, as well as their immediate family members, are not eligible to win prizes in the Campaigns, though they may view the Website.

2. INTELLECTUAL PROPERTY AND USE OF ASSET PACKS

2.1. Brand Ownership: All content on this Website, including but not limited to text, graphics, logos, button icons, images, digital downloads, data compilations, software, and trademarks (including "ASUS", "ProArt", and "ROG"), is the exclusive property of ASUS or its content suppliers and is protected by South African and international intellectual property laws. 2.2. Limited License for Asset Packs: ASUS may make downloadable "Asset Packs" available on the Website for specific Campaigns. ASUS grants the Participant a limited, non-exclusive, non-transferable, revocable license to download and use these Asset Packs solely for the purpose of creating a submission for the designated ProArt Create League Campaign. 2.3. Prohibited Use: You may not use the Asset Packs, logos, or brand names for any commercial purpose outside of this competition, nor may you alter, defame, or use the assets in a manner that brings the ASUS brand into disrepute.

3. CAMPAIGN SUBMISSIONS & USER-GENERATED CONTENT

3.1. Submission Process: To successfully enter a Campaign, Participants must follow the specified criteria: downloading the Asset Pack, adhering to the design brief, uploading the final creation to a public social media profile using the mandatory hashtags (#ProArtCreateLeague, #ProArt, #ProArtBounty), and submitting the valid live URL via the Website's entry form. 3.2. Originality: By submitting an entry, you warrant that the creation is your own original work (utilizing the provided Asset Packs), does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party, and has not been previously published or awarded a prize. 3.3. Grant of Rights: By entering a submission, the Participant grants ASUS a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display the submission (including the Participant's social media handle and likeness) across any media channels, including but not limited to official social media pages, websites, retail activations, and marketing presentations, without further compensation or notice.

4. PRIZES AND JUDGING

4.1. Prize Structure: Prizes for specific headline bounties (e.g., R5,000 cash or product rewards) and weekly challenges will be outlined in the respective creative briefs on the Website. 4.2. No Substitution: Prizes are non-transferable, non-negotiable, and cash alternatives will not be provided for product-specific prizes. 4.3. Judging Criteria: Winners will be selected based on creative flair, adherence to the technical design specifications, and alignment with the brand brief, as determined by a panel of judges appointed by ASUS. The judges’ decision is final, and no correspondence or disputes will be entered into. 4.4. Winner Notification: Winners will be contacted via the email address provided in the submission form or via direct message on the social media platform utilized for entry. If a winner cannot be contacted or fails to claim a prize within fourteen (14) days of notification, ASUS reserves the right to withdraw the prize and select an alternative winner.

5. PROHIBITED CONDUCT

When using the Website and participating in Campaigns, you agree not to:

1. Submit content that is defamatory, obscene, offensive, hateful, discriminatory, or promotes illegal activity.

2. Use automated systems, bots, or scripts to flood the submission forms or manipulate engagement/voting metrics.

3. Attempt to gain unauthorized access to the Website’s hosting servers, databases, or underlying code.

4. Decompile, reverse-engineer, or disrupt the performance of the Website.

6. PRIVACY AND DATA PROTECTION (POPIA COMPLIANCE)

6.1. ASUS is committed to protecting your privacy in accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA). 6.2. Personal information collected through the submission form (including your name, email address, contact details, and social media links) will be processed solely for the purposes of administering the ProArt Create League Campaigns, verifying identities, contacting winners, and delivering prizes. 6.3. 7. LIMITATION OF LIABILITY AND INDEMNITY

8. AMENDMENTS AND TERMINATION

ASUS reserves the right, in its sole discretion, to amend, modify, or update these Terms, or to cancel, suspend, or alter the terms of any Campaign or Bounty at any time without prior notice, particularly in the event of catastrophic events, fraud, technical failures, or changes in applicable law. 8.2. Any changes to these Terms will be posted on this page immediately with an updated "Last Updated" date. Your continued use of the Website following such changes constitutes your acceptance of the new Terms.

9. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by, construed, and interpreted in accordance with the laws of the Republic of South Africa.
